APPEAL from an order of the circuit court for Racine County: EMILY S. MUELLER, Judge. Reversed. In this interlocutory appeal, Wilbert L. Thomas argues that the circuit court erred by not granting his motion to dismiss a December 28, 1999 petition seeking his commitment as a Wis. Stat. ch. 980 (1997-98)1 sexually violent person. Thomas argues that the petition should have been dismissed for not conforming to the time limit in Wis. Stat. § 980.02(2)(ag) because it was filed after he had been discharged from his criminal sentence for a sexually violent offense. After reviewing the statute, we agree and conclude that an offender cannot be detained beyond his or her maximum discharge date in order to file a ch. 980 petition. The order is reversed.
